The intent of Ally Communications, LLC (“Ally Communications” or “the Company”) Acceptable Use Policy (AUP) is to improve the use of the Ally Communications services by proactively preventing unacceptable use.  All Ally Communication customers and customers of Ally Communications customers or any downstream customer including visitors of customers must comply with this AUP.  Violating any terms listed in this AUP may result in suspension or cancellation or your account without notice. Ally Communication reserves the right to refuse service to anyone.

    • SERVICE(S): Services means provisioning of voices services, wireless services, internet access (including Shared Bandwidth and Dedicated lines), domestic, international and toll free termination and origination, conferencing, hosting, server collocation, hardware sales and all related customer support services.
    • DEVICE(S) and EQUIPMENT: Devices and Equipment means any type of hardware (telephone, adapters, routers, modem, computers, servers, etc.). Devices and Equipment may be Customer owned or the property of Ally Communications.
    • SOFTWARE: Software means any computer programs or code, software applications, and any other software provided by Ally Communications to Customer pursuant to this Agreement.
  2. VIOLATIONS OF AUP: The following are violations of Ally Communication AUP.
    • LAWFUL PURPOSE ONLY: As a user of Ally Communication, you agree not to use the service in a manner that violates any local, state or federal law.
    • HARM TO OTHERS: Using the services to harm others, including but not limited to minors.
    • THREATS & HARASSMENT: You agree not to use the service for abusive, profane, libelous, slanderous, threatening or otherwise harassing calls.
    • FRAUDLENT ACTIVITY: Using the service to make or participate in fraudulent activity including financial scams.
    • COPYRIGHT or TRADEMARK INFRINGEMENT: Using the service to transmit any material that infringes any copyright, trademark, patent, trade secret, or other propriety rights of a third party.
    • COLLECTION OF PERSONAL DATA: Using the Service(s) to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
    • NO TRANSFER OF SERVICE: You may not resell or transfer your service or device or provide service to anyone else by using your Ally Communications service without first obtaining prior written consent.
    • NO ALTERATIONS or TAMPERING: If you copy or alter or have someone else copy or alter the firmware or software of the devices in any way that facilitates a compromise of your service, you are responsible for any charges that result. You may not attempt to hack or otherwise disrupt our services or may any use of our service that is inconsistent with its intended purpose.
    • THEFT OF SERVICE: You may not use or obtain our Service in any manner that avoids Ally Communications policies and procedures, including an illegal or improper manner. You will notify us immediately in writing if a device(s) is stolen or if you believe that your service(s) is being stolen, fraudulently used, or otherwise being used in an unauthorized manner. When you notify us of one of these events, you must provide your account number and a detailed description of the circumstances of the theft, fraudulent use, or unauthorized use of service. If you fail to notify us in writing in a timely manner, we may disconnect your service and levy additional charges on you. Until you notify us in writing, you will remain liable for all use of our service using a service stolen from you and any and all stolen, fraudulent or unauthorized use of the service up through the date notice is received by Ally Communications.
  3. MONITORING: We may monitor the use of our Services for violations to this agreement. We may, without liability, remove or block all communications if we suspect a violation of this agreement, or if we think it necessary in order to protect our services, Ally Communications, affiliates, directors, officers, agents, and employees from harm.
    • PROVINDING INFORMATION TO AUTHORITIES and THIRD PARTIES: If we believe you have user our Service(s) or your/our Device(s) or Equipment for an unlawful purpose, we may forward relevant communication and other information, including your identity, to the appropriate authorities. In addition, we may disclose any and all information and communications we possess, in response to law enforcement or other governmental agency requests: as required by law, regulation, rule, subpoena, search warrant or court order; as necessary to identify, contact, or bring legal action against someone who may be misusing the services, devices or both; to protect Ally Communications rights and property; or in emergency situations where disclosure of such information is necessary to protect Ally Communications customers or third parties from imminent harm.
  4. RIGHT OF CANCELLATION: In addition to Ally Communications’ right to cancel service for non-payment, Ally Communications reserves the right to cancel services immediately and without advanced notice if Ally Communications, in its sole discretion, believes that you have violated any of the above restrictions, leaving you responsible for the full charges to the end of the current term, including without limitation unbilled charges, plus a disconnect fee and any penalties, all of which immediately become due and payable.
  5. CHOICE OF LAW: You and Ally Communication agree that the law of the State of Alabama, U.S.A. will apply to all matters relating to this Agreement and to Ally Communication, Inc. In addition, you and Ally Communication agree and consent that the courts of State of Alabama will have exclusive jurisdiction and be the exclusive venue for any legal actions relating to this Agreement or to the services provided hereunder. Customers agrees to defend, indemnify and hold harmless Ally Communication, its officers, directors, employees, agents and licensees, from any claims and expenses, including reasonable attorney’s fees, arising out of or relating to member’s use of Ally Communication service. If any part of this agreement is unacceptable to you, you must immediately terminate your membership with Ally Communication. This agreement shall automatically renew on the stated periodic basis unless terminated by either party giving the other thirty days written notice.
  6. REVISIONS TO THIS DOCUMENT: Ally Communication reserves the right to revise, amend, or modify this AUP and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with the service.
